Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and TreePros San Marcos ("Company," "we," "our," or "us"), a tree service company operating in San Marcos, California, regarding your use of our website and tree service offerings.

By accessing our website, requesting services, or entering into a service agreement with us, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our website or services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

Services Offered

TreePros San Marcos provides professional tree services throughout San Marcos, California and surrounding areas, including but not limited to:

  • Tree removal and stump grinding
  • Tree trimming and pruning
  • Tree health assessment and diagnosis
  • Emergency tree services
  • Tree planting and transplanting
  • Lot clearing and brush removal
  • Arborist consultations
  • Fire prevention and defensible space creation

All services are subject to availability, weather conditions, and local regulations. We reserve the right to refuse service if we determine the work is unsafe, illegal, or beyond our capabilities.

Service Agreements and Estimates

Estimates and Quotes

We provide free estimates for most services. Estimates are based on visual inspection and information provided by the customer. Final pricing may vary if conditions differ from what was observed during the initial assessment.

  • Estimates are valid for 30 days from the date issued
  • Prices may change due to unforeseen circumstances or changes in scope
  • Additional charges may apply for difficult access, permit requirements, or disposal fees
  • Emergency services may be subject to premium pricing

Service Contracts

Once you accept our estimate, a service contract will be established. This contract includes:

  • Detailed description of work to be performed
  • Total cost and payment terms
  • Estimated timeline for completion
  • Specific terms and conditions for the work

Payment Terms

Payment Methods

We accept the following payment methods:

  • Cash
  • Check (made payable to TreePros San Marcos)
  • Credit and debit cards
  • Electronic bank transfers

Payment Schedule

  • Payment is due upon completion of services unless otherwise agreed in writing
  • For large projects, we may require a deposit of up to 50% before beginning work
  • Invoices are due within 30 days of the date issued
  • Late payments may be subject to a 1.5% monthly service charge
  • Returned checks will incur a $35 processing fee

Scheduling and Cancellation

Scheduling

Service scheduling is subject to weather conditions, crew availability, and local regulations. We will make every effort to complete work as scheduled, but dates may need to be adjusted due to:

  • Adverse weather conditions
  • Equipment issues or safety concerns
  • Permit delays or regulatory requirements
  • Emergency situations requiring immediate attention

Cancellation Policy

  • Customers may cancel services with 24 hours notice without penalty
  • Cancellations with less than 24 hours notice may incur a $150 trip charge
  • Deposits for cancelled services are refundable minus any costs already incurred
  • We reserve the right to cancel services due to safety concerns or weather conditions

Property Access and Customer Responsibilities

Access Requirements

Customer must provide safe and reasonable access to work areas, including:

  • Clear pathways for equipment and personnel
  • Removal of vehicles, furniture, and personal property from work areas
  • Access to electrical outlets if required
  • Gate codes or keys for secured areas

Underground Utilities

Customer is responsible for identifying and marking underground utilities before work begins. We recommend contacting DigAlert (811) at least 2 business days before scheduled work. TreePros San Marcos is not liable for damage to unmarked utilities.

Property Protection

We take reasonable precautions to protect your property during service. However, customers should remove or protect valuable items, decorative objects, and fragile landscaping in work areas. We are not responsible for damage to unmarked sprinkler systems, buried cables, or other hidden property features.

Permits and Legal Compliance

Tree work may require permits from local authorities. Unless specifically agreed otherwise in writing:

  • Customer is responsible for obtaining all necessary permits
  • Work may be delayed if permits are not obtained
  • Additional fees may apply if we assist with permit applications
  • We comply with all local tree protection ordinances and regulations
  • Protected trees may require special permits and approved arborist involvement

Insurance and Liability

Our Insurance Coverage

TreePros San Marcos maintains comprehensive insurance coverage including:

  • General liability insurance
  • Workers' compensation insurance
  • Commercial auto insurance
  • Professional liability coverage

Limitation of Liability

Our liability is limited as follows:

  • Maximum liability shall not exceed the total amount paid for services
  • We are not liable for consequential or indirect damages
  • Claims must be reported within 30 days of service completion
  • We are not responsible for pre-existing tree conditions or diseases
  • Natural events (weather, pests, disease) affecting trees after service are not our responsibility

Warranties and Guarantees

Service Warranty

We warrant that our services will be performed in a professional manner according to industry standards. This warranty covers:

  • Workmanship for a period of 30 days from service completion
  • Proper cutting techniques and safety procedures
  • Complete removal of debris (unless otherwise specified)

Limitations

Our warranty does not cover:

  • Tree health or survival after pruning or other services
  • Damage from weather, insects, disease, or other natural causes
  • Issues resulting from customer actions or negligence
  • Changes in tree appearance due to natural growth patterns

Safety and Emergency Services

Safety Commitment

Safety is our top priority. We reserve the right to:

  • Stop work if conditions become unsafe
  • Modify work methods to ensure safety
  • Require additional safety measures at customer expense
  • Refuse work that poses unacceptable risks

Emergency Services

Emergency services are available 24/7 for storm damage and hazardous tree situations. Emergency service rates apply and may include:

  • Premium pricing for after-hours and weekend service
  • Minimum charges for emergency calls
  • Priority scheduling over non-emergency work

Website Use Terms

Permitted Use

Our website is provided for informational purposes and to facilitate service requests. You may:

  • Browse our services and company information
  • Request estimates and schedule services
  • Contact us through provided forms and methods

Prohibited Activities

Dispute Resolution

Direct Resolution

We encourage direct communication to resolve any issues. Please contact us immediately if you have concerns about our services.

Mediation and Arbitration

If direct resolution is not possible, disputes will be resolved through:

  • First, good faith mediation in San Diego County, California
  • If mediation fails, binding arbitration under California law
  • Each party bears their own costs unless otherwise determined by arbitrator

Governing Law

These Terms are governed by the laws of the State of California without regard to conflict of law principles. Any legal action must be brought in the courts of San Diego County, California. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Severability and Entire Agreement

If any part of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in effect. These Terms, along with any written service agreements, constitute the entire agreement between you and TreePros San Marcos.

No oral representations or promises will modify these Terms unless confirmed in writing and signed by an authorized representative of TreePros San Marcos.
